This action arises from a kidney transplant procedure, recommended and performed by the defendants, Phillip Ayvazian, M.D. (“Dr. Ayvaz-ian”) and Jeffrey Stoff, M.D. (“Dr. Stoff j. Alleging that the transplant was unnecessary, Anne Montalto (“Montalto”), the transplant recipient, and Joseph Francis (“Francis”), the volunteer donor, brought medical malpractice claims against Drs. Ayvazian and Stoff. The matter is before the court on Dr. Ayvazian’s motion for summary judgment on Francis’ claims.
