Marvin Lee Kates (“Movant”) was charged with one count of abuse of a child in violation of Section 568.060, two counts of statutory sodomy in the second degree in violation of Section 566.064, and one count of victim tampering in violation of Section 575.270. 1 Following a bench trial, Movant was found guilty of abuse of a child and two counts of statutory sodomy in the second degree, and was sentenced to a total of six years imprisonment.
