Quinn, Chief Judge:

Charged with sodomy, the accused, who was twenty years of age, was convicted of assault with intent to commit sodomy, in violation of Article 134, Uniform Code of Military Justice, 10 USC § 934, by performing certain acts specified in the findings. The convening authority approved only so much of the court-martial’s findings of guilty as found that the accused “committed an indecent, lewd, and lascivious act” in the manner specified in the findings. He approved the sentence, which included a bad-conduct discharge and confinement at hard labor for one…
