Fried, J.), entered January 4, 2005, which granted plaintiffs motion to dismiss defendant’s counterclaims for fraud, negligent misrepresentation, breach of implied covenant of good faith and fair dealing, malpractice, and breach of fiduciary duty, unanimously reversed, on the law, with costs, the motion denied and said counterclaims reinstated.
