This action was commenced March 8, 1919, against the incorporated town of Wainwright to recover on a warrant issued to the Eureka Fire Hose Manufacturing Company in the sum of $499-.-68. The petition, in addition to the allegations necessary to recover on such an instrument, alleged that on or about the 12th day of July, 1916, the warrant was stolen from the plaintiff, and alleged the warrant to be wrongfully in the possession of the defendant.
