This action was commenced in the court below in 1927 by Herbert Thomas Bates against his wife, Annie Eliza Bates, for divorce on the statutory ground of extreme cruelty. After a full hearing upon the pleadings and evidence, judgmeht was for the husband; the wife appeals. The facts and the applicable law being somewhat involved, we shall for clearness give a brief history of the case.
