BOLIN, Judge.

This case was submitted in the lower court on an agreed stipulation of facts. During the course and scope of his employment with Matthews Lumber Company of Mansfield, Inc. Aaron Atkins was involved in an automobile accident with a car driven by Ola Mae Sawyer, resulting in both drivers being killed. Judgment was rendered in favor of Geneva Thomas, as tutrix of her minor children, against the lumber company for workmen’s compensation benefits due her children for the death of their father Aaron Atkins.
