Both parties appeal from the trial court’s rulings on the sufficiency of the third amended complaint of plaintiff, Ronald Heider (Heider). Counts I, II, and III purport to allege common-law fraud, a Restatement (Second) of Torts §353 (1965) violation, and tortious interference, respectively, arising from plaintiff’s purchase of a warehouse that contains asbestos insulation from defendant, Leewards Creative Crafts, Inc.
