—Affirming.

Tbe action was instituted by appellant against appellee to recover damages for the breach of an oral contract of sale for real estate situate in Harlan. The memorandum relied upon to take the case from out the purview of the Statute of Frauds (KRS 371.010) is a check signed by appellant, payable to appellee, which is in the following words and figures:'
