The question to be determined on this appeal is, whether there was a valid agreement to extend the time of payment of the notes in suit which operated to suspend the right of action of the plaintiffs upon the same, and thereby discharged the defendant as indorser. The notes were made and delivered as security for a loan made by the plaintiffs to the makers of the amount of the same, as appears by the findings of the referee, -with sufficient evidence to support the same.
