The defendant alleges error in the refusal of the court to direct a verdict of not guilty. The evidence tended to show that some time prior to July 23, 1924, defendant secured a job of cutting wood for one Robertson and secured permission to live in an old shack on the premises, where the wood was cut. The premises from which the wood was cut, and upon which defendant lived, consisted of 40 acres of cut-over stump and brush land, surrounded by other similar land. It was a secluded place.
