Baker, Chief Justice.

This action was brought by the respondent (plaintiff below), Momeier, a landowner, jointly against his neighboring landowner, Koebig, and a contractor, H. D. Ford doing business in the name of H. D. Ford Construction Company, who drove piles for the foundation of structures being erected by the neighboring landowner, Koebig, upon his premises, for damages to a residence on respondent’s adjacent lot resulting from the alleged negligent driving of the piling.
