OPINION
OGG, Judge.
These consolidated appeals arise out of a lease agreement entered into by plaintiffappellee, Cecil Lawter Real Estate School (Lawter) and third party defendant-appellant, Transamerica Development Company (Transamerica).
Prior to discussing the legal issues presented, we review the facts giving rise to these appeals. On September 14, 1970, Cecil B. Lawter and his wife, Isabelle Lawter, entered into a lease agreement with Transamerica, through its vice-president, Don Owen.
