The essential question in this case is whether C. B. Pusey met his death by accidental means, under an insurance policy providing for double liability if death was caused by external, violent and accidental means. A verdict for double liability was confirmed by the circuit court.

The evidence concerning the Pusey fatality, not opposed to probabilities and about which there are no contradictions nor specific discrediting circumstances, follows.
