The defendant, Mutual Life Insurance Company of New York, was awarded this writ to a $1,058.83 judgment obtained by Jessie C. Martin in a suit on a life insurance policy.

The policy in question, issued on August 17, 1923, to the plaintiff’s husband, Benjamin II. Martin, provided for payment of $1,000.00 to the insured’s wife upon due proof of his death; or in the event such death occurred directly and solely through external, violent and accidental means, double that amount was to be paid, unless the death resulted from certain excepted causes (including a violation of law by…
