Appellee prevailed in the trial court on his civil action seeking recovery against appellants for default on an unpaid promissory note (Count I) and for fraud and misrepresentation in negotiating the note (Count II). Before us on appeal, appellants frame only the narrow issue as to “Whether the trial court erred in awarding punitive damages on Count II when [it] failed to award compensatory damages.” In the context of the factual circumstances of this case, we find that the query requires an affirmative answer.
