1Opinion of the CourtMorgan, J.

Richard Salter appointed Thomas Hale and Peter Marcy executors of bis last will, and made them detainers of Ms estate. After his death the will was probated, and immediately thereafter tbe executors named presented their joint petition to the judge of tlie Second District Court of New Orleans, where the succession was opened, in which they prayed to be allowed to qualify as executors; *321they also prayed for an inventory. Their prayer was granted. Thomas Hale alone took the usual oath.

Before the inventory was commenced .the heirs of Salter, all of age, brought suit against Hale and Marey,…
