In an action to recover damages for the conscious pain and suffering of the plaintiff’s intestate, Robert J. Forman, and for his wrongful death, based upon the defendant’s alleged malpractice, the plaintiff administratrix appeals from a judgment of the Supreme Court, Nassau County, entered March 3, 1964 after trial, upon the verdict of a jury in defendant’s favor, dismissing the complaint upon the merits.
