In this case plaintiff by his amended bill of complaint sought certain injunctive relief, cancellation of a contract he had entered into with defendants, cancellation of a chattel mortgage he had given to the defendant partnership and of his in debtedness to it, and for a money judgment-against defendants. Such relief was sought on 2 separate theories: (1) cancellation on the ground of alleged fraud on the part of defendants with resulting damage to plaintiff, and (2) damages suffered by plaintiff as the result of defendants’ breach of their contract with plaintiff.
