STOKES, Justice.

This suit was instituted by appellee, D. B. May, as an appeal from an adverse ruling of the Industrial Accident Board upon his claim against appellant, Traders & *268General Insurance Company, for compensation for an injury and resulting incapacity sustained by him on the 21st of January, 1941. He alleged that the injury was sustained while he was performing duties in the course of his employment with the Herring National Company, a corporation, of which appellant was the compensation insurance carrier.
