This is an article 78 proceeding brought by a landlord to challenge the validity of subdivision 1 of section 21 of the regulations promulgated by the Temporary State Housing Bent Commission, pursuant to the 1950 State Emergency Housing Bent Control Law (L. 1950, ch. 250, § 4, subd. 1, par. [a]; McKinney’s Unconsol. Laws, § 8584, subd. 1, par. [a]).
