This matter is before the Court on the Motion for Summary Judgment filed by defendant, Consumers Union of United States, Inc. (“Consumers Union”). Pursuant to Fed. R.Civ.P. 56(c), Consumers Union seeks summary judgment in its favor on each of the four counts contained in the Complaint filed in this action by plaintiff, Quantum Electronics Corporation (“Quantum”).
