The first exception taken was to the admissibility of the record of the proceedings of the land sale of John Taisey, in 1833. The plaintiff claimed that the record was inadmissible for the following reasons :
1st. That there was no legal proof that the collector was sworn. The warrant recites that the tax was assessed by the legislature at the session held at Montpelier in 1831, and the appointment of John Taisey as collector of said tax.
