This is the second time this suit has been before this Court. 1 Texas Civ. App., 480. After the decision of the court reversing the judgment and remanding the cause, November 23, 1892, plaintiffs amended their original petition by amendment filed December 2, 1893. The original suit was brought August 8, 1888, for damages against San Saba County for alleged unlawful appropriation of land by plaintiffs for a public road.
