This case comes before us on demurrer to tbe second count of the declaration, which count sets forth that the defendant’s intestate at Providénce on July 23, 1857, made his promissory note for $500 payable to James A. Requa or order two months after date, and that said Requa then and there indorsed and delivered it to the plaintiff; that it was not paid at maturity; that after maturity, and before any part of it was paid, it was lost by the plaintiff; that after the loss the plaintiff demanded payment of the defendant, and the defendant refused payment.
