This action was brought under the third section of the Mechanics’ Lien act, to recover money due to the plaintiff from William Mosher. The contract price for the building was $2,500, payable in installments, as follows: $500'when the frame was up; $700 when the sides and roof were on; $500 when the floors were laid, partitions set and rough plumbing in; $400 when the outside work was finished and one coat of paint on, the leaders up and the plumbing fixtures on the premises; and the final payment of $400 when the building was completed and…
