Glenda Miera, and others, for themselves and on behalf of all other persons similarly situated, brought the present action against the First Security Bank of Utah, N.A., a Utah corporation (Bank), charging violations of the Securities Exchange Act of 1934 arising out of the Bank’s handling of their stock interests in the Ute Distribution Corporation. 15 U.S.C. § 78j and Rule 10b-5, 17 C.F.R. § 240.10b-5. The plaintiffs alleged, inter alia, that they were all “terminated” or “mixed-blood” members of the Ute Indian Tribe of the Uintah and Ouray Reservations who had…
