Presently before the Court are three motions for summary judgment: (1) a motion by Sam Nicholson (“Nicholson”) (Doc. No. 44); (2) a motion by Hooters of Augusta, Inc. (“Hooters”) (Doc. No. 54); and (3) a joint motion by American General Insurance Company (“AGIC”) and Zurich Insurance Company (“Zurich”). (Doc. No. 58.)
