KNIGHT, Chief Judge.

Trial was had on July 30, 1953 to the Court without a jury — trial by jury having been waived. The issue is whether or not *29under the circumstances of the case the Selective Service System has failed to take certain procedural steps which defendant claims are necessary to his proper processing.
