Appellant was arraigned before a general court-martial convened at Fort George G. Meade, Maryland, charged with attempted robbery and attempted murder while perpetrating a robbery, in violation of Article 80, Uniform Code of Military Justice, 10 USC § 880, and robbery, in violation of Article 122, Uniform Code of Military Justice, 10 USC § 922. He pleaded not guilty as charged but, with reference to- the attempted robbery and robbery specifications, he pleaded guilty only to assault, in violation of Article 128 of the Uniform Code, supra, 10 USC § 928.
