The defendant, Elbert Herrion, was charged in the county court of Murray county with the crime of unlawful possession of intoxicating liquor, was tried, convicted and sentenced to serve 30 days in the county jail and pay a fine of $300, and has appealed.

In order to dispose of this case it is only necessary to Consider one of the many assignments of error presented in the brief of the defendant.
