The defendant, Donald W. Gottschalk, appeals from a verdict and judgment for the plaintiff, Valerie Duncza, in the amount of $6,500. Plaintiff’s action was for an assault and battery upon her by the defendant.

Defendant’s assignments of error are (1) that the verdict was excessive and the result of passion or prejudice, (2) that there was no sufficient or proper evidence of damages to sustain the verdict, and (3) that the trial court erred in not granting defendant a judgment notwithstanding the verdict or a remittitur or a new trial because the evidence as a matter of law would not…
