BAKER, Judge.

The appellant was convicted of unlawfully driving and operating an automobile upon a public highway while intoxicated, and his punishment fixed at a fine of $25.00.

It was the contention of the state that on December 25, 1925, the appellant, while under the influence of intoxicating liquor, drove his automobile upon the public road in Cherokee County, known as the Jim Hogg highway.
