Ex Parte Bibbins

The petitioner herein filed Ms petition for a writ of habeas corpus in this court seeking Ms release from the State Penitentiary. He alleges that he is unlawfully restrained of his liberty by O. P. Burford, warden of said penitentiary, under and by virtue of a judgment and sentence made and entered in tbe district court of Osage county, Okla., on tbe 2nd day of April, 1945. Petitioner does not attack tbe jurisdiction of tbe district court of Osage county as being improper in tbe bearing of tbe case as referred to but does attack the judgment of tbe court in said cause.
