In October, 1871, William. *514Eborn of North Carolina presented to Zimpelman, the administrator of the estate of his brother, Thomas Eborn, (who at the time of his death, early in 1871, was, and for many years had been, a citizen of Austin, Texas,) a claim duly authenticated, on the following instruments:
“Borrowed and received from William Eborn nine hundred dollars, which I promise to return when called for, with interest.
“ February 3,1846.
