Appeal by defendant Frank Fish, from a judgment of the court of oyer and terminer of the county of Canandaigua, entered upon the verdict of a jury convicting him of murder in the first degree. The facts sufficiently appear m the opinion of the court.

The defendant was convicted of murder in the first degree on the 24th day of May, 1890, for killing John Cullinane on thé prior 26th day of January, at Canandaigua, in this state. There is no substantial dispute about the facts of the case. The defendant at the time of the homicide was about 24 years old, 5 feet 5 inches in height, weighed about 140 pounds, and was a painter by occupationCullinane was a moulder, over six feet in height, weighed about 190 pounds,. and was about thirty years old, and they were both married and householders.
