Having considered the evidence presented by the parties relevant to the due process issue, the Court concludes as follows:

The plaintiffs allege that defendants deliberately punish inmates using administrative segregation rather than bringing disciplinary charges, in order to circumvent the due process protection they would have to provide the prisoner if he or she were charged with a disciplinary infraction.
