This case involves the joint appeal of three brothers seeking reversal of the January 8, 2002, final orders of the Circuit Court of Tucker County whereby Brian Smsky was convicted of one count of obstructing an officer, David Smsky was convicted of one count of trespassing on property other than a structure, and Thomas Smsky was convicted of one count of trespassing on property other than a structure or conveyance and two counts of removing a “posted” sign.
