MEMORANDUM OPINION & ORDER
PAUL G. GARDEPHE, District Judge:
The Board of Trustees , of the Upstate New York Engineers Pension Fund brings this action pursuant to Section .502 of the Employee Retirement Income Security Act of 1974-(“ERISA”), 29 U.S.C. § 1132, against Defendants Ivy Asset Management, Lawrence Simon, Harold Wohl, and Bank of. New York Mellon Corporation.
