NIX, Judge.
Jerry Hathcock, hereinafter referred to as defendant, was convicted of the crime of Burglary Second Degree, After Former Conviction of a Felony, in the District Court of Pottowatomie County, and sentenced to a term of from 7 to 21 years in the penitentiary.
This cause was filed in this Court on June 10, 1965, alleging numerous assignments of error. Brief was due to be filed by July 10, 1965. On August 31, some 52 days late, and out of time, extension of time to brief was asked for and this Court granted defendant 45 days in which to file brief, or by October 15, 1965. None was…
