The defendant appeals from a judgment and decree in specific performance.

Plaintiff alleged and the court found that Art 0. Miller died intestate, leaving an estate in the county of Los Angeles consisting of real and personal property. Cora Lee Baker (who has since married, and whom we will refer to as the “plaintiff”), was the surviving widow, and the defendant, Orrilla Z. Miller, was the surviving mother of said deceased.
