In the petition filed in this cause in November, 1911, it is charged that the defendant' in error, in June, 1908, was a duly qualified notary public in and for Pottawatomie county, Okla., and that on said date, as said notary public, he certified an acknowledgment to a certain mortgage as having been executed and acknowledged before him by Dan Brown and James Millet, which mortgage was on certain real estate in Seminole county, to one C.
