Equity. On appeal. Cause heard below on intervening petition of Twohy Brothers Company and answer thereto.

The facts found by the sitting Justice and about which there seems to be no dispute are as follows:

“August 18, 1924, a bill in equity was filed in accordance with the provisions of Sec. 89, Ch. 51, Rev. Stat. 1916, as amended, for the dissolution of the defendant corporation. The bill was brought by all of the stockholders of the corporation which included the president and the treasurer, but it appears by the bill that Isaac Elston, Jr., the president, had assignments from the others of…
