This case is before the court for consideration of plaintiffs motion for default judgment [8-1] or, in the alternative, motion for a remand to State Court of For-syth County with an award of reasonable attorneys’ fees and expenses [8-2] filed on July 30,1998. The facts giving rise to these motions are as follows.
