NORVELL, Justice.
The controlling question presented by this appeal is whether or not the appellee, Nueces County Navigation District No. 1, is authorized to acquire the fee simple title to land (exclusive of minerals and all mineral rights), by condemnation proceedings. The County Court of Nueces County held for the district in two separate cases which have been appealed to this Court. The two appeals were submitted and argued together.
