In an action, inter alia, to recover damages for legal malpractice, the defendant appeals, as *287limited by his brief, from so much of an order of the Supreme Court, Suffolk County (Gerard, J.), dated December 6, 2000, as denied his motion to dismiss the complaint for failure to state a cause of action, and the plaintiffs cross-appeal from so much of the same order as denied their cross motion for summary judgment.

Ordered that the order is affirmed, without costs or disbursements.
