OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW
DUNCAN, Judge.
The appellant was convicted of driving while intoxicated (hereinafter referred to as “DWI”) resulting in serious bodily injury to another as proscribed by Art. 6701/ -1(b), (f) V.A.C.S.1 The appellant waived a jury trial and pursuant to a plea agreement entered a plea of nolo contendere to the charge.2 The information charged appellant with DWI and included an “enhancement paragraph” alleging another person suffered serious bodily injury as a result of the offense.
