McCLUNG, Justice.
As the result of a nearly head-on collision, Martin Vargas Rivera was charged with causing serious bodily injury while driving while intoxicated. Tex.Rev.Civ.Stat.Ann. art. 6701l-1(f) (Vernon Supp.1986). Upon a new trial motion filed jointly by appellant’s attorney and the State, appellant was convicted of this offense on retrial and was sentenced to serve two years in county jail and pay a $600 fine.
