LANGDON, Chief Justice.

This proceeding involves an attempted appeal by Oxsheer Smith and Pecos Petroleum Company from an interlocutory order of the District Court of Reeves County, overruling defendants’ pleas of privilege. The order overruling the pleas of privilege was signed and entered on the 5th day of December, 1958. Defendants excepted to the court’s ruling and gave notice of appeal and immediately thereafter requested the clerk to prepare a transcript and the reporter to prepare a statement of facts.
