On January 9, 2015, the court dismissed Plaintiff CMG Worldwide, Inc.’s, Complaint for failure to state a claim upon which relief can be granted. Count III alleged Defendants violated Section 10(b) under the Securities and Exchange Act of 1934 (“Securities Act”) and Rule 10b-5; and Count IV alleged Defendants violated Section 20(a) of the Act.
